Environmental compliance in Wales

Wales shares most of its environmental law with England but runs its own regulator, Natural Resources Wales, and has gone further in several areas: all workplaces have had to separate recycling since April 2024, hazardous waste producers still register their premises, and the Welsh deposit return scheme will include glass.

Regulator: Natural Resources Wales. See all UK regulators.

What differs in Wales, guide by guide

Battery regulations: producer responsibility and take-back

Same UK regime, administered by Natural Resources Wales.

Climate change agreements and the Climate Change Levy

Same UK-wide scheme; Welsh facilities deal with the Environment Agency as administrator.

Deposit return scheme for drinks containers (from October 2027)

Separate scheme under the Deposit Scheme for Drinks Containers (Wales) Regulations 2026, run by Exchange for Change from October 2027. Includes glass, with a four-year transition during which glass carries a zero deposit and is exempt from labelling.

Mandatory digital waste tracking

In force since 1 October 2026, enforced by Natural Resources Wales. Household waste recycling centres are outside the scope.

Environmental permits: who needs one, how to apply and what it costs

Same 2016 Regulations as England, but Natural Resources Wales is the regulator with its own charging scheme. NRW no longer issues standard rules permits for medium combustion plant, and the decarbonisation readiness requirements introduced in England in 2026 do not apply.

ESOS Phase 4 (Energy Savings Opportunity Scheme)

The same rules and dates apply. Natural Resources Wales is the compliance body for participants whose activities are in Wales.

F-gas regulations for refrigeration, air conditioning and heat pumps

Same GB rules, enforced by Natural Resources Wales alongside the Environment Agency's GB-wide quota administration.

Hazardous waste: classification, consignment notes and returns

Premises producing or holding more than 500kg of hazardous waste in 12 months must register with NRW and renew annually; registration is now free. Otherwise the 2005 Regulations apply as in England.

ISO 14001:2026 environmental management systems

Same standard. Welsh Government procurement applies its own policy notes; carbon reduction plan requirements may differ from PPN 006.

Medium combustion plant and specified generator permits

Same deadlines under the 2016 Regulations, regulated by Natural Resources Wales, which issues bespoke rather than standard rules permits for MCP.

Minimum energy efficiency standards (MEES) for let property

The 2015 Regulations apply in Wales on the same terms as England, including the 2030 and 2031 decisions, which cover England and Wales.

Packaging EPR (extended producer responsibility for packaging)

Same UK regime, enforced by Natural Resources Wales. Welsh fees fund Welsh local authorities. Wales's DRS will include glass with a four-year transition, which affects which containers leave EPR.

Plastic packaging tax

A UK-wide tax administered by HMRC; no national differences.

SECR reporting (Streamlined Energy and Carbon Reporting)

Same rules as England. Companies registered in England and Wales file with Companies House in the usual way.

Single-use plastics bans, vapes, wet wipes and carrier bag charges

The Single-use Plastic Products (Wales) Act 2023 banned the first group of items from 30 October 2023 with a second phase (carrier bags, polystyrene lids, oxo-degradables) planned; disposable vapes banned since 1 June 2025; wet wipes with plastic banned from 18 December 2026, the first in the UK; 5p carrier bag charge.

UK Sustainability Reporting Standards and climate disclosures

UK-wide company law and FCA rules apply identically; no national differences.

UK carbon border adjustment mechanism (UK CBAM) from 2027

A UK-wide tax administered by HMRC; no national differences.

UK Emissions Trading Scheme (UK ETS)

Natural Resources Wales regulates Welsh installations under the same UK-wide scheme.

Waste carrier, broker and dealer registration (and the move to permits)

Keeps the two-tier registration system under the 2011 Regulations, administered by Natural Resources Wales: £184 new, £126 renewal, lower tier free.

Waste duty of care and waste transfer notes

The same section 34 duty and Code of Practice apply, enforced by Natural Resources Wales and councils. Digital waste tracking has been mandatory for receiving sites since 1 October 2026. Wales also has separate workplace recycling separation duties with their own fixed penalties.

Waste exemptions: when you can operate without a permit

The same Schedule 3 exemptions apply, registered with Natural Resources Wales; check NRW's current charges. The reform package is a joint Defra and Welsh Government policy.

Trade effluent consents, water discharge permits and abstraction licences

The same legal framework as England, with Dŵr Cymru Welsh Water (or Hafren Dyfrdwy) issuing trade effluent consents and Natural Resources Wales issuing permits and abstraction licences.

WEEE regulations: producers, retailers and online marketplaces

Same UK regime; Natural Resources Wales registers Welsh producers. Welsh workplaces must also separate all small WEEE for collection under the workplace recycling rules.

Workplace recycling rules: Simpler Recycling and the devolved regimes

All workplaces since 6 April 2024: paper and card; glass; metal, plastic and cartons; food (5kg+ a week); small WEEE (all since 6 April 2026); unsold textiles. Bans on food waste to sewer, recycling to landfill or incineration, and wood to landfill. Fixed penalties £300 (occupiers) and £500 (collectors).
