Environmental compliance in Northern Ireland
Northern Ireland's rules are made at Stormont and enforced by the Northern Ireland Environment Agency, part of DAERA. Under the Windsor Framework some EU product rules continue to apply in Northern Ireland, so the F-gas, batteries and single-use plastics regimes can differ from Great Britain. UK-wide schemes such as packaging EPR, ESOS and the deposit return scheme include Northern Ireland.
Regulator: NIEA (DAERA). See all UK regulators.
What differs in Northern Ireland, guide by guide
- Battery regulations: producer responsibility and take-back
The 2009 Regulations apply for producer responsibility, but the EU Batteries Regulation 2023/1542 applies in Northern Ireland for product requirements under the Windsor Framework, including the February 2027 removability rule.
- Climate change agreements and the Climate Change Levy
Same UK-wide scheme and levy rates; Northern Irish facilities deal with the Environment Agency as administrator.
- Deposit return scheme for drinks containers (from October 2027)
Joins the England scheme under SI 2025/67 from 1 October 2027, run by UK DMO and enforced by NIEA.
- Mandatory digital waste tracking
Mandatory from January 2027 according to DAERA and GOV.UK, enforced by NIEA. Check DAERA's digital waste tracking page for the Northern Ireland regulations.
- Environmental permits: who needs one, how to apply and what it costs
NIEA issues PPC permits (Part A and B), waste management licences and water discharge consents under separate laws; district councils issue Part C permits. There is no single permitting regime.
- ESOS Phase 4 (Energy Savings Opportunity Scheme)
The same rules and dates apply. The Northern Ireland Environment Agency is the compliance body. Wholly or mainly offshore participants are regulated by OPRED instead.
- F-gas regulations for refrigeration, air conditioning and heat pumps
Regulation (EU) 2024/573 applies under the Windsor Framework, enforced by NIEA: a steeper HFC phase-down, additional bans on high-GWP gases in new equipment from 2027 and a phase-out of HFCs by 2050.
- Hazardous waste: classification, consignment notes and returns
Hazardous Waste Regulations (Northern Ireland) 2005: consignor must pre-notify NIEA at least 72 hours before a movement; waste hierarchy declaration on the note; records for 3 years; fees £24, £10 or free.
- ISO 14001:2026 environmental management systems
Same standard. Northern Ireland public procurement applies its own procurement guidance notes.
- Medium combustion plant and specified generator permits
Regulated by NIEA under the Pollution Prevention and Control (Industrial Emissions) (Medium Combustion Plant) Regulations, with the same 2024 and 2029 deadlines.
- Packaging EPR (extended producer responsibility for packaging)
Same UK regime, enforced by NIEA. Northern Ireland joins the England DRS from 1 October 2027.
- Plastic packaging tax
A UK-wide tax administered by HMRC; goods moving from Great Britain to Northern Ireland are not imports for the tax.
- SECR reporting (Streamlined Energy and Carbon Reporting)
Same SECR rules and thresholds. On summary conviction, fines for LLP members are capped at the statutory maximum in Northern Ireland.
- Single-use plastics bans, vapes, wet wipes and carrier bag charges
EU Single-Use Plastics Directive restrictions apply under the Windsor Framework; disposable vapes banned since 1 June 2025; wet wipes with plastic banned from 18 May 2027; 25p carrier bag levy.
- UK Sustainability Reporting Standards and climate disclosures
UK-wide company law and FCA rules apply identically; no national differences.
- UK carbon border adjustment mechanism (UK CBAM) from 2027
Goods moving from Great Britain to Northern Ireland are not imports for UK CBAM; imports from outside the UK into Northern Ireland are covered. Northern Ireland businesses trading with the EU should also check the EU CBAM.
- UK Emissions Trading Scheme (UK ETS)
NIEA regulates Northern Irish installations, except electricity generators, which remain in the EU ETS under the Windsor Framework.
- Waste carrier, broker and dealer registration (and the move to permits)
NIEA registration under the 1999 Regulations: upper tier £180 new and £90 renewal, lower tier free. Maximum fine £5,000 for unregistered carrying.
- Waste duty of care and waste transfer notes
The duty of care sits in the Waste and Contaminated Land (Northern Ireland) Order 1997 and NIEA's code of practice. Transfer note contents and the 2-year retention mirror Great Britain. Digital waste tracking starts in January 2027.
- Waste exemptions: when you can operate without a permit
Exemptions from waste management licensing are registered with NIEA under the Waste Management Licensing Regulations (Northern Ireland) 2003.
- Trade effluent consents, water discharge permits and abstraction licences
Trade effluent consents from NI Water under the Water and Sewerage Services (Northern Ireland) Order 2006; discharge consents under the Water (Northern Ireland) Order 1999 and abstraction licences under the 2006 Regulations, both from NIEA.
- WEEE regulations: producers, retailers and online marketplaces
Same UK regime; NIEA registers Northern Irish producers. Because the WEEE Regulations are UK legislation, the EU WEEE Directive changes apply only where the Windsor Framework requires.
- Workplace recycling rules: Simpler Recycling and the devolved regimes
Food businesses producing more than 5kg a week must separate food waste and must not put it to sewer; dry recyclables presented separately. No Simpler Recycling equivalent; a new resources and waste strategy was consulted on in 2026.
