Environmental compliance in England
England has the largest body of environmental regulation in the UK and the most active enforcement. The Environment Agency regulates permits, waste, water and climate schemes; local authorities regulate smaller air-pollution processes and enforce many product bans. Several England-only reforms are in train, including waste carrier permitting from July 2027 and the biodiversity net gain rules changed in August 2026.
Regulator: Environment Agency. See all UK regulators.
What differs in England, guide by guide
- Battery regulations: producer responsibility and take-back
The 2009 Regulations apply UK-wide; the Environment Agency registers English producers and approves compliance schemes.
- Biodiversity net gain (BNG) for development in England
Mandatory 10% BNG under Schedule 7A since February and April 2024, with the 6 August 2026 exemptions and hierarchy changes; NSIPs to follow.

A UK-wide scheme administered by the Environment Agency for all four nations; HMRC collects the levy.
- Deposit return scheme for drinks containers (from October 2027)
Scheme under SI 2025/67, run by UK DMO from 1 October 2027. PET, aluminium and steel containers of 150ml to 3 litres; glass excluded. Enforced by the Environment Agency and Trading Standards.
- Mandatory digital waste tracking
In force since 1 October 2026 under SI 2026/729, enforced by the Environment Agency with fixed penalties of £1,000, variable penalties and prosecution.
- Environmental permits: who needs one, how to apply and what it costs
The Environment Agency regulates most permits under the 2016 Regulations, with councils handling Part A2 and Part B installations. Since 28 February 2026, new and substantially refurbished in-scope generating plant must also show decarbonisation readiness.
- ESOS Phase 4 (Energy Savings Opportunity Scheme)
The Environment Agency enforces ESOS in England and is also the scheme administrator for the whole UK, running MESOS and publishing data.
- F-gas regulations for refrigeration, air conditioning and heat pumps
Retained F-gas Regulation 517/2014 and the 2015 Regulations, enforced by the Environment Agency, which also runs the GB HFC registry and quota system.
- Hazardous waste: classification, consignment notes and returns
No producer registration since 1 April 2016. Consignment notes parts A to E with SIC 2007 and EWC codes; consignee fees £10 or £19 per note; quarterly consignee returns; records kept 3 years.
- ISO 14001:2026 environmental management systems
ISO 14001 is an international standard applied identically across the UK. PPN 006 applies to central government contracting authorities in England and non-devolved bodies.
- Medium combustion plant and specified generator permits
Regulated by the Environment Agency under Schedule 25A and 25B of the 2016 Regulations; standard rules permits available for most plant; existing 1 to 5 MW plant permitted by 1 January 2029.
- Minimum energy efficiency standards (MEES) for let property
The 2015 Regulations apply: EPC E floor for all lettings, with EPC B for non-domestic buildings over 1,000 m² by 2031 and EPC C for rented homes by 1 October 2030 decided but not yet legislated. Enforced by local authorities.

- Plastic packaging tax
A UK-wide tax administered by HMRC; no national differences.
- SECR reporting (Streamlined Energy and Carbon Reporting)
SECR applies in the same way across the UK because it sits in UK-wide company law. Summary fines for LLP members are unlimited in England and Wales.
- Single-use plastics bans, vapes, wet wipes and carrier bag charges
Bans on straws, stirrers and cotton buds (2020) and cutlery, plates, bowls, trays, balloon sticks and polystyrene containers (2023); disposable vapes banned since 1 June 2025; wet wipes with plastic banned from 19 May 2027; 10p carrier bag charge for all retailers.

- Waste exemptions: when you can operate without a permit
Registered online with the Environment Agency for £58.13 plus a compliance charge per exemption; valid 3 years. Confirmed reforms will remove U16, T8 and T9 and tighten seven others, date to be set.
