Environmental compliance in Scotland
Scotland regulates through SEPA under its own framework. Since 1 November 2025 waste, water and industrial activities have been authorised under the Environmental Authorisations (Scotland) Regulations (EASR), replacing the old licences and registrations. Business recycling duties, special waste rules and the biodegradable landfill ban also differ from England.
Regulator: SEPA. See all UK regulators.
What differs in Scotland, guide by guide
- Battery regulations: producer responsibility and take-back
Same UK regime, administered by SEPA.
- Climate change agreements and the Climate Change Levy
Same UK-wide scheme; Scottish facilities deal with the Environment Agency as administrator, not SEPA.
- Deposit return scheme for drinks containers (from October 2027)
Scotland's earlier 2023 scheme was replaced by alignment with the UK-wide approach: launch in October 2027, PET and metal only, administered by UK DMO.
- Mandatory digital waste tracking
In force from 1 January 2027 under SSI 2026/145, enforced by SEPA alongside EASR. Fines and compliance notices apply, but no fixed penalty.
- Environmental permits: who needs one, how to apply and what it costs
The England and Wales permitting regulations do not apply. Since 1 November 2025 SEPA authorises water, waste and industrial activities under EASR through general binding rules, notifications, registrations and permits.
- ESOS Phase 4 (Energy Savings Opportunity Scheme)
The same rules and dates apply. SEPA is the compliance body in Scotland, and Scottish public procurement law defines which public bodies are excluded.
- F-gas regulations for refrigeration, air conditioning and heat pumps
Same GB rules, enforced by SEPA.
- Hazardous waste: classification, consignment notes and returns
Regulated as special waste under the Special Waste Regulations 1996 and, since 1 November 2025, within EASR for sites and carriers. No producer registration; SEPA consignment codes SA £15, SB £10, SC free; notes submitted electronically; pre-notification only for cross-border movements.
- ISO 14001:2026 environmental management systems
Same standard. Scottish public procurement has its own rules and sustainability requirements under the Procurement Reform (Scotland) Act 2014.
- Medium combustion plant and specified generator permits
Regulated by SEPA under EASR since 1 November 2025; SEPA sets application windows by plant type, including electricity-generating plant in 2028.
- Packaging EPR (extended producer responsibility for packaging)
Same UK regime, enforced by SEPA. Scotland is aligned with the October 2027 DRS launch for PET and metal containers; glass stays in packaging EPR.
- Plastic packaging tax
A UK-wide tax administered by HMRC; no national differences.
- SECR reporting (Streamlined Energy and Carbon Reporting)
Same SECR rules and thresholds. On summary conviction, fines for LLP members are capped at the statutory maximum in Scotland.
- Single-use plastics bans, vapes, wet wipes and carrier bag charges
The longest list, in force since 1 June 2022, including oxo-degradable products; fines up to £5,000; disposable vapes banned since 1 June 2025; wet wipes with plastic banned from 11 August 2027; 10p carrier bag charge.
- UK Sustainability Reporting Standards and climate disclosures
UK-wide company law and FCA rules apply identically; no national differences.
- UK carbon border adjustment mechanism (UK CBAM) from 2027
A UK-wide tax administered by HMRC; no national differences.
- UK Emissions Trading Scheme (UK ETS)
SEPA regulates Scottish installations; the Scottish Government is a member of the UK ETS Authority.
- Waste carrier, broker and dealer registration (and the move to permits)
Since 1 November 2025 carriers and brokers are authorised under EASR as a registration (£304.10 new, £198.55 renewal every 3 years) with standard conditions that have applied since 1 April 2026.
- Waste duty of care and waste transfer notes
Section 34 applies, with SEPA's own duty of care code. Waste carriers, brokers and sites have been authorised under EASR since 1 November 2025, so check SEPA's public register for EASR authorisations. Digital waste tracking starts on 1 January 2027.
- Waste exemptions: when you can operate without a permit
Since 1 November 2025 the former exemptions sit within EASR as general binding rules, notifications or registrations with SEPA, depending on risk.
- Trade effluent consents, water discharge permits and abstraction licences
Trade effluent consents from Scottish Water under the Sewerage (Scotland) Act 1968; discharges and abstractions authorised by SEPA under EASR since 1 November 2025, using general binding rules, registrations and permits.
- WEEE regulations: producers, retailers and online marketplaces
Same UK regime; SEPA registers Scottish producers.
- Workplace recycling rules: Simpler Recycling and the devolved regimes
Waste (Scotland) Regulations 2012: separate glass, metal, plastic, paper and card; food businesses producing 5kg or more a week separate food waste (rural exemption). Fines up to £10,000 summary, unlimited on indictment.
